Drug Court in Tooele County
The state of Utah established drug courts in 1996, with the first court opening in Salt Lake County. Since then, however, these state-sponsored courts have made their way throughout the state. Tooele County supports the drug court of the third district court. The drug court of Tooele County works with local law enforcement, treatment providers, public defenders and more to find restorative justice solutions to drug offenders.
Offenders, referred to as “clients” while in the program, undergo treatment and counseling and are treated as addicts, not as criminals.
Toole County Youth Court
Reinstated in 2019, the Youth Court of Tooele County is an alternative court system for juvenile offenders. If law enforcement chooses to refer their charge to the Youth Court, the offender is adjudicated by a group of youth under the supervision of adult advisors and the coordinator. If successful, the offender will complete the punishment or restorative justice actions set out by the court and will not have the charge placed on their juvenile record.
Tooele County Plea Bargains
According to Tooele County: “There are simply not enough resources within our office, the court system, and law enforcement to take most cases to trial.” Therefore, the county employs “plea bargains” for low-risk cases, or cases that can be solved quickly.
Tooele County’s policy for determining plea bargains are based on:
- Severity of the crime;
- Expressed desires of victims;
- Safety of victims, witnesses, and the community;
- Strength of admissible inculpatory and exculpatory evidence;
- Rehabilitation opportunities for defendant;
- Cooperation of defendant;
- Defendant’s criminal history;
- Defendant’s prior probation/parole history;
- Extent of defendant’s participation in charged crimes; and
- Any aggravating or mitigating facts or circumstances
